These Terms of Service (“Terms”) govern your access to and use of the Atheryx platform (“Service”), operated by Atheryx (“we”, “our”, or “us”). By creating an account or using the Service, you agree to be bound by these Terms.
By accessing or using Atheryx, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.
You agree to use Atheryx only for lawful purposes and in accordance with these Terms. You must not:
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account. We are not liable for losses arising from unauthorised account access due to your failure to keep credentials secure.
Atheryx provides tools for coaches to create and deliver training programs to their athletes. Atheryx is a technology platform only and does not provide fitness, medical, or health advice. Coaches are solely responsible for the content of their programs and the appropriateness of that content for individual athletes. Athletes are responsible for their own health and safety, and should consult a qualified professional before beginning any new exercise program.
You retain ownership of any content or data you submit to Atheryx, including workout logs, training programs, and survey responses. By submitting content, you grant Atheryx a limited licence to store, process, and display that content for the purpose of providing the Service. We may use anonymised, aggregated data to analyse usage trends and improve the platform, but we will never share individually identifiable data with third parties for commercial purposes.
You may stop using Atheryx at any time. We reserve the right to suspend or terminate your access if you violate these Terms or engage in conduct harmful to the platform or other users. Upon termination, you may request an export of your data. Following account deletion, your personal data will be removed in accordance with our Privacy Policy.
The Service is provided “as is” and “as available” without warranty of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Use of the Service is at your own risk.
To the maximum extent permitted by applicable law, Atheryx shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
We may revise these Terms from time to time. We will notify users of material changes by email or by posting a notice on the platform. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
